A 4 terms
Due Dates & Installments
  • 15th June: 15% of estimated tax
  • 15th September: 45% of estimated tax
  • 15th December: 75% of estimated tax
  • 15th March: 100% of estimated tax
  • Senior citizens without business income are exempt u/s 207.
Practical Example

Rohan is a freelance web developer earning ₹18 Lakhs. His estimated tax liability after 44ADA is ₹1,40,000. He must pay advance tax by March 15th (100% allowed for presumptive filers), or face 1% monthly interest penalties under Section 234C and Section 234B.

What AIS Tracks
  • Savings bank interest & Fixed Deposit interest with TDS
  • Dividends received from listed shares and mutual funds
  • Stock market share purchases, mutual fund sales, and crypto transactions
  • Property sales/purchases above ₹30 Lakhs and foreign remittances
Practical Tip

Always cross-verify your ITR figures with the Taxpayer Information Summary (TIS). If an AIS transaction is duplicate or incorrect, submit an online feedback on the e-filing portal immediately to avoid automated mismatch notices under Section 143(1).

Statutory Provisions

Applies to LLPs, sole proprietorships, and partnerships claiming deductions under Chapter VI-A (Section 80H to 80RRB) or Section 35AD. AMT credit can be carried forward up to 15 assessment years under Section 115JD. Note: AMT does not apply if opting for the New Tax Regime u/s 115BAC.

Practical Example

An LLP develops an SEZ unit claiming 100% deduction under Section 80-IAB, reducing normal tax to ₹0. AMT mandates paying 18.5% on adjusted profits, ensuring a baseline contribution to the exchequer while generating carry-forward tax credits.

Key Difference

Financial Year (FY): The year in which you earn income (e.g., April 1, 2024 to March 31, 2025 is FY 2024-25).
Assessment Year (AY): The year in which that income is assessed and return is filed (e.g., April 1, 2025 to March 31, 2026 is AY 2025-26).

Common Confusion

When downloading ITR forms or paying advance tax/self-assessment challans, always select AY 2025-26 for income earned during FY 2024-25. Selecting the wrong AY can misallocate your tax payments to the wrong ledger.

Consequences & Penalties

A late fee under Section 234F of ₹5,000 applies (reduced to ₹1,000 if total taxable income is below ₹5 Lakhs). In addition, interest at 1% per month under Section 234A is charged on outstanding tax liability, and capital or business losses cannot be carried forward.

Practical Example

Anjali missed filing her return on July 31, 2025. She files on November 15, 2025. Because her total income is ₹8.5 Lakhs, she pays a ₹5,000 late fee under 234F. She can still claim TDS refunds, but cannot carry forward a ₹50,000 stock trading loss to future years.

Statutory Mechanism

If income tax payable under normal provisions of the Income Tax Act is less than 15% of Book Profits, the book profit itself is deemed total taxable income. MAT credits can be carried forward for up to 15 assessment years under Section 115JAA. MAT does not apply to companies opting for Section 115BAA/BAB (22% concessional rate).

Practical Impact

A tech startup with massive accelerated depreciation deductions shows zero taxable income under the IT Act but ₹2 Crore net profit in its audited balance sheet. It must pay MAT at 15% plus surcharge and cess on that ₹2 Crore.

Key Restrictions

Non-speculative business losses can be set off against any head of income (House Property, Capital Gains, Other Sources) except Salary Income under Section 71(2A). Speculative trading losses (equity intraday) can only be set off against speculative profits.

Practical Scenario

Vikram operates an e-commerce boutique resulting in a ₹3 Lakh loss, while earning ₹5 Lakhs in interest and rental income. He can set off the entire ₹3 Lakh loss against his interest/rental income, reducing his net taxable income to ₹2 Lakhs.

C 5 terms
Exclusions from Capital Asset

Stock-in-trade (inventory), personal effects (clothing, furniture, personal cars), and specified rural agricultural land are strictly excluded from the definition of a capital asset and do not generate capital gains tax upon transfer.

Practical Rule

Selling your personal car or laptop at a gain does not trigger capital gains tax because they are personal effects. However, selling gold jewelry, paintings, or virtual digital assets (crypto) are statutory exceptions and are taxable as capital gains.

Statutory Timeline

If you sell a residential property and cannot purchase/construct a replacement home before the ITR filing due date (July 31), you must deposit the unutilized capital gains into a CGAS account (Type A savings or Type B term deposit) before filing your ITR.

Practical Scenario

Sunil sells a property in May 2024 with ₹40 Lakhs capital gains. He plans to buy an apartment in 2026. To claim exemption in his AY 2025-26 ITR, he deposits ₹40L in a CGAS account with SBI before July 31, 2025.

Key Rules & Time Limits

Business losses and capital gains losses can be carried forward for up to 8 assessment years. House property losses can be carried forward for 8 years. Unabsorbed depreciation can be carried forward indefinitely. Mandatory Rule: The ITR must be filed on or before the due date u/s 139(1) to retain this benefit!

Crucial Warning

If you file a belated return (after July 31), you forfeit the carry-forward benefit for business losses and stock trading losses for that year, costing you potential tax deductions in future profitable years.

Computation Breakdown

Cess is not applied to gross income; it is calculated directly on the total tax liability (after surcharge, if any). Section 40(a)(ii) retrospectively clarifies that health & education cess is strictly non-deductible as a business expenditure.

Example Calculation

If your basic income tax is ₹1,00,000, cess is 4% × ₹1,00,000 = ₹4,000. Your total payable tax becomes ₹1,04,000 before TDS adjustments.

Budget 2024 Major Change

For sales after July 23, 2024, indexation has been replaced with a flat 12.5% LTCG rate. However, for properties acquired before July 23, 2024, resident taxpayers can choose whichever is lower: 12.5% without indexation OR 20% with indexation.

Indexation Formula

Indexed Cost = Purchase Price × (CII of Sale Year / CII of Purchase Year). CII for FY 2024-25 is 363 (Base Year 2001-02 = 100).

D 3 terms
Statutory Conditions

The company must possess accumulated profits (capitalized or not) up to the extent of the loan. The amount is taxed at the shareholder's applicable slab rates under 'Income from Other Sources', with 10% TDS u/s 194.

Practical Warning

Company promoters frequently borrow funds temporarily from their Pvt Ltd bank accounts for personal real estate investments. Assessing officers routinely classify these loans as Deemed Dividends, demanding slab taxes plus penalty interest.

Key Asset Depreciation Rates

Computers & Laptops: 40% WDV. Plant & Machinery: 15%. Commercial Vehicles: 30%. Non-residential Buildings: 10%. If an asset is put to use for less than 180 days in the purchase year, only 50% of the normal depreciation rate is allowable.

Practical Benefit

A digital agency buys MacBooks worth ₹10 Lakhs on October 5th. Because they were put to use for more than 180 days, the firm claims a 40% depreciation deduction (₹4,00,000) directly against taxable agency income in year 1.

How Relief Works

Relief is provided via the Exemption method or Foreign Tax Credit (FTC) method u/s 90. To claim DTAA concessional tax rates (e.g. 10%-15% on royalty, fees for technical services, or dividends), non-residents must furnish a Tax Residency Certificate (TRC) and Form 10F.

Practical Scenario

An NRI living in the USA earns ₹5 Lakhs in interest from an NRO account in India. Standard Indian TDS is 30% plus cess. Under the India-US DTAA, the withholding tax rate is capped at 15%, saving the NRI 50% in immediate tax deduction.

E 3 terms
Key Specifications

Consists of Part A (GSTIN of supplier & recipient, delivery place, invoice number, HSN code) and Part B (vehicle registration number/transporter ID). Validity is calculated based on transit distance: 1 day for every 200 km (or part thereof).

Penalty for Non-Compliance

Transporting goods without a valid E-Way Bill triggers vehicle impoundment and penalty under Section 129 equal to 200% of the applicable tax amount.

Budget 2024 Abolition

The 6% levy applies to B2B online advertisement payments exceeding ₹1 Lakh annually to foreign entities (e.g. Google, Meta). Note: Budget 2024 officially abolished the 2% equalisation levy on foreign e-commerce operators effective August 1, 2024.

Withholding Mandate

Indian businesses paying for foreign ad campaigns must deduct 6% equalisation levy and deposit it by the 7th of the following month, filing Form 1 annually by June 30th.

Exemption (Section 10)

Income that does not form part of total income at all (e.g. Agricultural income u/s 10(1), HRA u/s 10(13A), Gratuity u/s 10(10)). It is deducted before computing Gross Total Income.

Deduction (Chapter VI-A)

Subtractions allowed after calculating Gross Total Income to incentivize specific investments (e.g. Section 80C for PPF/ELSS, Section 80D for medical insurance). Deductions cannot turn taxable income into a net loss.

F 4 terms
Part A vs Part B

Part A: TRACES-generated summary showing employer/employee PAN/TAN, quarterly tax deducted, and government challan numbers.
Part B: Detailed annexure with gross salary, perquisites, Section 10 exemptions (HRA, LTA), Standard Deduction, and Chapter VI-A deductions.

Statutory Deadline

Employers are legally required to issue Form 16 to employees on or before June 15th immediately following the financial year. Failure incurs a penalty of ₹100 per day under Section 272A(2)(g).

Key Sections Inside 26AS

Part A (TDS on Salary & non-salary), Part B (TCS by car dealers/sellers), Part C (Tax paid via Challan 280), Part D (Tax refunds received from CPC), Part E (High-value SFT transactions), Part F (TDS on immovable property u/s 194-IA).

Why Form 26AS is Crucial

Even if your employer or client gave you a physical TDS slip, you cannot claim tax credit in your ITR unless it is actively reflected in Form 26AS. If missing, the deductor has failed to file their quarterly TDS returns (Form 24Q/26Q).

Form 67 Filing Requirement

Form 67 must be submitted online on the e-filing portal on or before the end of the relevant assessment year (i.e. by December 31st) to claim FTC against your Indian tax computation. It must be accompanied by foreign tax payment receipts or withholding certificates.

Practical Scenario

Pooja works remotely from Bengaluru for a US tech company. The US employer withheld 30% US federal tax. By filing Form 67 and claiming DTAA Article 25 credits, Pooja avoids paying double tax on that salary income in India.

Statutory Alignment

In income tax nomenclature, Financial Year is synonymous with 'Previous Year' (PY). All financial records, bank statements, invoice dates, and investments made between April 1 and March 31 govern the computation for that financial cycle.

Tax Planning Cut-off

All tax-saving investments under Chapter VI-A (PPF, ELSS, NPS, Mediclaim) must be executed before March 31st midnight of that Financial Year to be eligible for deductions in that year's ITR.

G 4 terms
5 Statutory Heads of Income

1. Salaries • 2. Income from House Property • 3. Profits and Gains of Business or Profession (PGBP) • 4. Capital Gains • 5. Income from Other Sources (Interest, Dividends, Lottery). GTI = Sum of all 5 heads.

Net Taxable Income Formula

Net Taxable Income = Gross Total Income (GTI) minus Chapter VI-A Deductions (80C, 80D, 80G, etc.). Tax slabs apply directly to Net Taxable Income, rounded to the nearest ₹10 under Section 288A.

Tax Components

CGST + SGST: Levied equally on intra-state supplies (within same state).
IGST: Levied on inter-state supplies (across state borders) and import of goods/services.
Threshold Limits: ₹20 Lakhs for service providers (₹10L special states), ₹40 Lakhs for goods suppliers.

Mandatory Registrations

Mandatory regardless of turnover for interstate suppliers of goods, casual taxable persons, non-resident taxable persons, and e-commerce marketplace sellers under Section 24 of the CGST Act.

Due Dates & Mechanics

GSTR-1: Due on the 11th of the following month (13th for quarterly IFF under QRMP). Auto-populates buyer's GSTR-2B.
GSTR-3B: Due on the 20th of the following month (22nd/24th under QRMP). Actual tax payment happens during GSTR-3B filing.

Section 75(12) Recovery

If tax declared in GSTR-1 exceeds tax paid in GSTR-3B, the difference can be recovered directly as self-assessed tax arrears without prior show cause notice under Section 75(12).

Section 16 Eligibility Criteria

1. Must possess tax invoice • 2. Goods/services must be received • 3. Supplier must have paid the tax to the government • 4. Invoice must be reflected in buyer's GSTR-2B statement • 5. Buyer must pay supplier within 180 days (or reverse ITC with interest).

Blocked Credits (Section 17(5))

ITC is strictly prohibited on passenger motor vehicles (≤13 seating capacity), food and beverages, outdoor catering, health club memberships, personal travel, and goods lost/stolen/gifted.

H 2 terms
Statutory Exemption Formula

Minimum of the following three is exempt:
1. Actual HRA received from employer
2. 50% of Basic Salary + DA (for metro cities: Delhi, Mumbai, Kolkata, Chennai) or 40% (non-metro)
3. Actual rent paid minus 10% of Basic Salary + DA.

Mandatory PAN Condition

If annual rent paid exceeds ₹1,00,000 (₹8,333/month), furnishing the landlord's PAN to your employer is legally mandatory under CBDT circulars. In the New Tax Regime (Section 115BAC), HRA exemption is completely disallowed.

Tax Planning Benefits

An HUF enjoys its own separate basic exemption limit (₹3 Lakhs in New Regime or ₹2.5 Lakhs in Old Regime), independent Chapter VI-A deductions (Section 80C up to ₹1.5L, 80D up to ₹25K), and can hold ancestral real estate, stocks, and mutual funds.

Practical Scenario

A family transfers ancestral rental property to their HUF. The HUF files its own ITR, claims separate deductions, and distributes wealth among coparceners tax-free under Section 10(2), legally saving ₹1.5L+ in annual taxes.

Three Possible Outcomes

1. No Demand / No Refund: Return accepted exactly as filed.

Practical Scenario

Karan forgot to report ₹4 Lakhs of crypto and stock gains in his AY 2024-25 return filed in July 2024. In February 2025, he discovers the omission in his AIS. He files an ITR-U before March 31, 2025, paying tax plus 25% penalty tax, legally avoiding criminal prosecution or 200% penalty.
